These Terms of Service ("Terms") govern your access to and use of FansXpress (the "Platform"), operated by FansXpress LLC, 75 E 3rd St, Sheridan, WY 82801, USA. By creating an account or using the Platform you agree to these Terms. If you do not agree, do not use FansXpress.
1. Eligibility & age
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use FansXpress. By using the Platform you represent and warrant that you meet this requirement. Every creator and every person appearing in uploaded content must also be 18 or older. We may require identity and age verification at any time and may suspend accounts that fail it.
2. Your account
- You are responsible for the accuracy of your information and for all activity under your account.
- Keep your password secure and notify us immediately of any unauthorized use.
- One person may not operate multiple accounts to evade suspensions or restrictions.
3. Creators, content & ownership
Creators retain ownership of the content they post. By posting, you grant FansXpress a limited, worldwide, non-exclusive licence to host, store, encode, display and deliver that content solely to operate the Platform (for example, showing it to fans you have granted access to). This licence ends when the content is removed, except for copies we must retain for legal or backup purposes.
You represent that you own or have all necessary rights to everything you upload, and that it does not infringe anyone else's rights.
4. Prohibited content & conduct
The following are strictly prohibited and will lead to removal, suspension and, where required, reporting to authorities:
- Any content featuring minors, or anyone who appears to be a minor.
- Non-consensual content, or content posted without the consent of everyone depicted.
- Content depicting real violence, coercion, trafficking, bestiality, or other illegal acts.
- Impersonation, harassment, doxxing, hate speech, or threats.
- Uploading someone else's content without permission (see section 9, DMCA).
- Spam, malware, scraping, or attempts to breach Platform security.
5. Records (18 U.S.C. §2257)
Creators are responsible for maintaining age and identity records for every performer in their content as required by 18 U.S.C. §2257 and applicable law. The custodian of records information is available at FansXpress LLC, Custodian of Records, 75 E 3rd St, Sheridan, WY 82801, USA. By uploading, you confirm such records exist and are available on lawful request.
6. Payments, subscriptions & tips
- Fans may subscribe to creators, unlock pay-per-view content, or send tips. Prices are set by creators within limits we may define.
- Payments are processed by third-party providers; their terms also apply. We do not store full card details.
- Except where required by law, purchases are non-refundable once content is unlocked or a subscription period begins.
- FansXpress retains a platform fee of 20% on creator earnings; the rest is payable to creators under section 7.
7. Creator payouts
Eligible creators may withdraw earnings once they meet the minimum payout threshold of $50, subject to identity/tax verification and a holding period of 14 days to cover chargebacks and refunds. We may withhold payouts linked to fraud, chargebacks, or Terms violations. Creators are responsible for their own tax obligations.
8. Fan conduct & content use
Content you access is for your personal, non-commercial use only. You may not copy, record, screenshot for redistribution, download (except where a creator explicitly enables it), resell, or publish creators' content anywhere. Doing so may be a breach of these Terms and of the creator's copyright.
9. Copyright & DMCA
We respect intellectual-property rights. If you believe content infringes your copyright, send a notice to dmca@fansxpress.com including: identification of the work, the infringing URL, your contact details, a good-faith statement, and your signature. We will act on valid notices and may remove content and terminate repeat infringers.
10. Termination
You may close your account at any time. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or where required by law. Sections that by their nature should survive (ownership, payments owed, disclaimers, liability, disputes) continue after termination.
11. Disclaimers & liability
The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, FansXpress is not liable for indirect or consequential damages, and our total liability is limited to the amount you paid us in the 3 months before the claim.
12. Governing law & disputes
These Terms are governed by the laws of the State of Wyoming, USA. Disputes will be resolved in the courts of the State of Wyoming, USA, unless mandatory local law provides otherwise.
13. Changes & contact
